Terms Of Services

Lawn Care Service Terms of Service

 

1. Scope of Services

- Spencer's Lawn Care ("Contractor") agrees to provide scheduled lawn maintenance services to the Client at the specified location(s) as agreed upon.

- Services may include mowing, edging, trimming, and blowing of hard surfaces

- Grass will be mowed at a height between 3 and 4 inches unless otherwise requested by the Client.

- The Contractor will determine the best mowing height based on factors such as grass type, season, and lawn health.

 

2. Service Fees

- The Client agrees to pay the price as stated in the approved estimate, which can be found in their email.

- Prices are subject to change due to changes in the lawn, including but not limited to:

  - Excessive growth requiring additional time and resources for mowing.

  - Overfertilization resulting in accelerated grass growth.

  - Additional obstacles from plant and/or landscaping installations.

- The Client will be notified of any price changes prior to Contractor completing another service, and a new estimate will be sent for approval before any additional services are performed.

- The Client and contractor will agree on billing structure.  Clients must have a payment method on file to be on the schedule.  Invoices will be billed through the Contractors CRM to the card on file, in accordance with the agreed billing terms.

- Invoices and receipts are sent via email/text. 

 

3. Scheduling and Cancellations

- The Client agrees to provide at least 24 hours' notice for cancellations or rescheduling of services.

- Contractor reserves the right to reschedule services due to inclement weather or other unforeseen circumstances.

- A $10 cancellation fee will be applied for cancellations made within 24 hours of the scheduled service.

 

4. Property Access

- Client gives permission for all Contractor personnel to be on the property during Contractor's regular business hours.

- Service day and time are subject to change based on weather conditions.

- The Client agrees to provide access to the lawn, unlock gates on the expected day of service, and ensure it is clear of any obstacles or hazards prior to service.

- Contractor is not liable for damage to property or items left on the lawn.

 

5. Client Responsibilities

- The Client agrees to maintain clear communication with the Contractor regarding scheduling, changes, and any issues with the service.

- The Client is responsible for notifying the Contractor of any specific requests or concerns regarding the lawn care.

- The Client agrees to keep the yard clear of toys, pet waste, and any other items that may obstruct the mowing process.

- Small areas of standing water will be skipped, and Clients will be billed in full.

- Company policy prevents the Contractor from moving trampolines.

- The Client agrees to notify the Contractor in the event of other work that may interfere with the ability to complete the lawn maintenance, such as construction projects or landscaping activities.

- The Client agrees to notify the Contractor if there are utility flags added to the lawn. Areas with an excessive amount of utility flags will be skipped, and Clients will be billed in full.

 

6. Skipped Weeks Due to Drought or Heat

- The Contractor reserves the right to skip lawn cutting as needed due to drought or extreme heat conditions that may negatively impact the lawn.

- Clients will not be billed for skipped weeks due to drought/lack of growth.

- The Contractor will determine when it is necessary to skip a week of lawn cutting for the health of the lawn.

- Not applicable to annual plan or commercial accounts

 

7. Skipped Weeks Due to Flooding

- The Contractor reserves the right to skip lawn cutting if the lawn is inaccessible or unsafe due to flooding conditions.

- In such cases, the Client will incur a 50% additional charge on the following service to accommodate for increased time and resources required.

- The Contractor will notify the Client of any skipped weeks due to flooding as soon as practicable.

 

8. Skipped Weeks Requested by Client

- If a Client requests to skip a week of lawn cutting for any reason, including drought, travel, or any other reason, there will be an additional 50% charge on the following service for added time and resources.

 

9. Liability

- Contractor will take reasonable care in performing services but is not liable for damages to property or injury unless caused by negligence. Certain areas of lawn are prone to unavoidable wear from tire tread.

- The Client agrees to indemnify and hold harmless the Contractor from any claims, damages, or liabilities arising from the services.

 

10. Termination of Services

- Either party may terminate services with written notice (email or text).

- Contractor reserves the right to terminate services for non-payment or violation of terms.

 

11. Governing Law

- This agreement shall be governed by the laws of North Carolina.

- Any disputes arising from this agreement shall be resolved through arbitration.

 

12. Entire Agreement

- This agreement constitutes the entire understanding between the Contractor and the Client and supersedes all prior agreements.

 

13. Acceptance

- By engaging the services of the Contractor, the Client agrees to these Terms of Service

 

Mulch Installation Terms of Service

 

1. Scope of Services

- Spencer's Lawn Care ("Contractor") agrees to provide mulch installation services to the Client at the specified location(s) as agreed upon.

- Services may include delivery, spreading of mulch, bed preparation, and edge re-defining in designated areas.

 

2. Service Fees

- The Client agrees to pay the price as stated in the approved estimate, which can be found in their email.

- The Client agrees to pay a materials deposit fee as outlined in the approved estimate.

- The Client agrees to be billed upon completion of the mulch installation service.

-  Clients must have a payment method on file to be on the schedule.  Invoices will be billed through the Contractors CRM to the card on file, in accordance with the agreed billing terms.

- Invoices and receipts are sent via email/text. 

- Payment is to be billed to the payment on file.

- The Client is responsible for notifying the Contractor of any specific requests or concerns regarding the mulch installation.

- The Client agrees to clear the designated areas of any obstacles prior to the scheduled service.

 

6. Weather Delays

- In the event of inclement weather or unsuitable ground conditions, the Contractor reserves the right to postpone mulch installation.

- The Client will be notified of any rescheduling due to weather conditions.

- Mulch installation will be rescheduled at the earliest convenient time for both parties.

- Contractor will take reasonable care in performing services but is not liable for damages to property or injury unless caused by negligence.

- The Client agrees to indemnify and hold harmless the Contractor from any claims, damages, or liabilities arising from the services.

Shrub and Ornamental Tree Trimming Terms of Service

 

1. Scope of Services
- Spencer's Lawn Care ("Contractor") agrees to provide shrub and ornamental tree trimming services to the Client at the specified location(s) as agreed upon.
- Services may include pruning, shaping, and trimming of shrubs, bushes, and ornamental trees.

2. Service Fees
- The Client agrees to pay the price as stated in the approved estimate, which can be found in their email.
- The Client agrees to be billed upon completion of the shrub and ornamental tree trimming service.

Payment is to be billed to the payment on file.

- The Client agrees to provide at least 24 hours' notice for cancellations or rescheduling of services.
